PROTECTIVE COVENANTS AND BUILDING

RESTRICTIONS OF FORESTON MEADOWS, CITY OF FORESTON, MILO TOWNSHIP,

MILLE LACS COUNTY


Gary & Carol Judd, personal representatives of the Foreston Meadows hereto declares that the hereinafter set forth restrictions shall apply to the land described in attached Exhibit "A" and warrants and covenants to and with all future owners of said lots that all

conveyances made by them shall be subject to the following restrictions, to-wit:


  1. No lot shall be used except for residential purposes.  No structure of temporary character, trailer, mobile home, modular home, manufactured home, basement, tent, shack, garage, barn, or other outbuilding shall be used on any lot at any time as a residence.


  1. No building shall be erected, altered, placed, or permitted to remain on any lot other than one single family dwelling not to exceed two and one-half (2 ½) stories in height, together with an attached garage.  A minimum of a two-car garage must be completed at the time the house is constructed.


  1. Completion of the exterior of any structure must be within 180 days from the date a building permit is issued by The City of Foreston.


  1. Earth homes and Berm homes are specifically prohibited.


  1. One permanent building in addition to the home is permitted per lot.  The maximum size of the additional building shall be one thousand five hundred (2,000) square feet and a maximum height of sidewalls shall be fourteen (14) feet.


  1. There shall be no un-enclosed storage on any lot of motor vehicles, recreational vehicles, marine craft, or trailers of any type which are not currently licensed or not in working order.  There shall be no un-enclosed storage on any lot of motor vehicle parts, implements, junk, refuse, or other unsightly materials of any type.


  1. For purposes of these covenants, eaves, steps, and open porches shall be construed as part of a building.  No building shall be located on any lot nearer to the property lines than specified in The City of Foreston and Mille Lacs County zoning ordinances.  All buildings shall conform to all applicable building codes.


  1. No noxious or offensive activity shall be carried on upon any lot nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood.  Not in restriction of the foregoing, but in addition thereto, it is specifically prohibited to have or maintain on the premises any livestock, fowl, horses, or animals of any kind except household pets and no pet kennels for breeding or boarding purposes.


  1. These covenants shall automatically run with the land, perpetually.


  1. Enforcement shall be by proceedings at law or in equity against person or persons violating or attempting to violate any covenant either to restrain violation or to recover damages.


  1. Invalidation of any one of these covenants by judgment or court order shall in no way effect any of the other provisions, which shall remain in full force and effect.
